(1) This puppy will be checked by our veterinarian before leaving SWEET BREE'S AUSSIES and therefore is guaranteed to be healthy upon receipt: if, as the new owner/s, you have the puppy checked again within 48 hours (and it is a very good idea to do this), please notify us immediately if you discover any problems.
(2) This dog is sold as a show potential puppy (that is, that it is free from disqualifying faults and genetic diseases that should not be propagated), exhibits proper breed type and structure well within the breed standard, and is sold with full registration. Because of the variables involved in titling a dog, no guarantee is made that this dog will acquire a Champion of Record title. Proper training, socialization, and physical exercise are required of the BUYER if this dog is to reach its full potential. Failure of the BUYER to provide such a regimen will NOT constitute reasonable cause for replacement.
(3) The above dog is guaranteed against hip dysplasia and hereditary eye defects: evidence of such defects must be in the form of OFA certification for hips obtained between the age of 24 and 30 months or, for the eyes, from CERF evaluation performed between the age of 12 and 18 months. The dog is also guaranteed against any AKC standard disqualification faults.
(a) If another puppy of same quality and same sex is available from a kennel owned litter, the dog named above will be replaced one time only -- after SWEET BREE'S AUSSIES receives a Veterinarian's certificate stating the dog has been euthanized (but please notify us before taking such drastic action), or after the dog has been immediately returned to SWEET BREE'S AUSSIES. If the owner refuses the puppy of choice, the contract is void at that time and no replacement will be sent.
OR (b) If no other puppy is available, the purchase price will be refunded upon the immediate return of the puppy to SWEET BREE'S AUSSIES.
OR (c) Upon proof of neutering/spaying, SWEET BREE'S AUSSIES will refund the difference between the sale price of a standard companion puppy and the purchase of this puppy [no return necessary].
All of the above conditions must be met for this provision to remain in force.
This guarantee becomes null and void once this dog has been used for breeding.
(3) The aforementioned dog must clear the OFA with a minimum of a "fair" rating and have a current CERF certification before breeding takes place. If the dog is bred before the eyes and hips are certified, this contract will no longer be valid and binding
(4) BUYER agrees to breed this animal only to Australian Shepherds which meet the breed standard (which have no disqualifying faults) and which have passed OFA and annual CERF certification. Any offspring from the aforementioned dog must also be registered with AKC. Puppies must have tails docked (if not natural bobs of less than 1/4 inch at birth) and have at least rear dewclaws removed if present.
(5) Offspring from this dog may not be sold to any commercial center (i. e., pet shops) nor to anyone intending to breed for commercial resale.
(6) BUYER agrees to take good and reasonable care of said dog; feed and house him properly, control him when off his premises, avoid loss by theft or running away, prevent damage by other dogs or otherwise, and promptly secure the best of veterinary attention for the physical welfare of the dog.
(7) BUYER agrees to keep the above dog in a safe and proper environment so that the dog will neither be allowed to roam at large nor be kept tethered -- a fenced yard being the appropriate means of restraint.
(8) BUYER promises to properly socialize this puppy and to complete minimum training. Temperament problems resulting from poor training or handling will not fall within the limits of the guarantee.
(9) Should this dog ever need to be rehomed, the BUYER will contact the SELLER for rehoming or new home approval. SELLER will at any time welcome aforementioned dog back should BUYER ever become unable to care for it.
(10) Breeder reserves three (3) breedings from a male to any bitch of choice during the reproductive lifetime of the dog.
(11) The dog's registered name (appearing at the top) will remain the same and shall not have any other prefix or suffix added whatsoever. OR, if the puppy has not yet been registered, "SWEET BREE'S" must be the first part of the dog's registered name.
(12) Should disputes involving this dog arise, they will be resolved in court in Mobile County, Alabama. Any fees arriving from legal dispute shall be the responsibility of the BUYER.
